CONSTRUCTION LITIGATION

The firm represents all aspects of construction law on behalf of developers, contractors, subcontractors, suppliers, management companies and other construction professionals, from contract drafting and review to litigation and arbitration. Contested matters include breach of contract and related claims, construction defects and delays, mechanics’ liens, bond claims, job abandonment disputes, and workmanship claims.


Landlord-Tenant

Commercial and residential landlords can face a host of issues that require legal counsel, from simple evictions and appeals to more complex Fair Credit Reporting Act Claims to Motions to Lift Stay in bankruptcy, just to name a few. Randy has represented landlords and management companies since 2000 and has litigated every imaginable claim they face.


BUSINESS BROKER AN BUSINESS SALE LITIGATION

Business brokers bring buyers and sellers of businesses together. Often times, the broker is only paid a commission if the deal is closed, in addition to a relatively minor stipend for expenses. Brokers can work months without getting paid. Litigation can arise when buyers and sellers decide to eliminate the commission altogether, sometimes by nefarious means. The Law Office of J. The firm represents secured and unsecured creditors affected by financial insolvency issues, in all aspects of bankruptcy, including filing motions to lift stay and, when necessary, filing adversary proceedings arising out of fraudulent transfers.

Most business disputes involve, among other things, breach of contract claims, and usually competing claims—that is, both sides claim the other is in breach. I don’t know how many times I have litigated a case where both sides spent tens of thousands in fees that would have been avoided by a simple review of the contract prior to execution. All deals are different, and having our office review your contract four an hour or two ahead of execution could save a year or two of litigation down the road.
